End user licence agreement

This agreement covers your use of the ShipTrace software. It is between you, the company whose account is used to sign in, and ShipTrace, LLC. Accepting it is a condition of using the portal.
Who this is between
ShipTrace, LLC, 1010 E Dallas Rd, Suite 101, Grapevine, TX 76051, United States. In this agreement “we” and “ShipTrace” mean that company, and “you” means the business whose account is used to sign in, together with anyone you allow to sign in under it.
The licence
We grant you a non-exclusive, non-transferable, revocable licence to use the ShipTrace portal and its mobile application for your own business, for as long as your account is in good standing. The software is licensed, not sold, and we keep every right we do not grant here.
You may let your own staff and contractors use it on your behalf. You are responsible for what they do with it.
What you may not do
Do not resell, sublicense or provide the software as a service to anyone else. Do not reverse engineer, decompile or attempt to derive our source code except where the law says you may. Do not remove or obscure our notices, or any carrier’s notices, marks or disclaimers.
Do not use the software to track packages that are not yours to track, and do not enter a carrier account number that your business is not entitled to use.
Your carrier accounts
ShipTrace can show tracking information from your own carrier, alongside the position our smart labels report. To do that you may give us your carrier account number, and we may request credentials from that carrier that let us read tracking information for your account.
Those credentials are used for one purpose: reading tracking information about your shipments so we can show it to you. We do not book shipments, buy labels, request pickups, cancel anything, or make any other change against your carrier account, and we never charge anything to it. You can remove your carrier account number from the portal at any time, and doing so stops us reading it.
Your carrier account remains yours and is governed by your own agreement with that carrier. Nothing here changes it.
Carrier tracking information
Tracking information shown in ShipTrace that comes from a carrier is that carrier’s account of where it handled your package, and is provided as the carrier supplies it. It records checkpoints after the fact and is not a live position. We do not alter it, and we cannot vouch for its accuracy, completeness or timeliness.
Where a carrier names a town, we may show that town on a map. That mark is the place the carrier named, not a measured position of your package.
The FedEx service marks are owned by Federal Express Corporation and are used by permission.
Label position data
Positions reported by a ShipTrace smart label are observations from the tracking network, reported with a stated accuracy. We show that accuracy rather than implying a precision we did not receive. Coverage is not guaranteed everywhere, and a period with no reports means nothing arrived, which is not the same as a package that did not move.
Availability and support
We aim to keep the service available but do not promise uninterrupted operation. We may change or withdraw features. If we make a change that materially reduces what the service does for you, we will tell you.
No warranty
The software is provided “as is”. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent the law allows, neither party is liable for indirect, incidental, special or consequential loss, or for lost profits or lost business. Our total liability arising out of this agreement is limited to the amounts you paid us in the twelve months before the claim arose.
Nothing in this agreement makes any carrier liable to you for the software, and no carrier is a party to it.
Ending it
You may stop using the software at any time. We may suspend or end your licence if you breach this agreement. When the licence ends, your right to use the software ends with it; we will make your data available to you for a reasonable period, and our privacy policy says how long we keep it after that.
